Els contractes que vencin entre el 22 de mar\u00e7 del 2026 i el 31 de desembre del 2027 tenen dret a estendre\u2019s dos anys m\u00e9s, indica la norma que va aprovar l\u2019 Executiu contra els efectes de la crisi a l\u2019 Orient Mitj\u00e0.<\/p>\n<p><\/p>\n<p class=\"paragraph\">Ara b\u00e9, aquesta mesura no sempre surt a compte i, de fet, t\u00e9 una aplicaci\u00f3 una mica m\u00e9s baixa del que s\u2019ha dif\u00f3s, afirmen col\u00b7legis professionals i juristes. Tot aix\u00f2 \u00e9s per \u201cl\u2019embolic legislatiu\u201d que envolta l\u2019acc\u00e9s a l\u2019habitatge, afirmen les fonts consultades, fet que dificulta aclarir-se i saber del cert quina llei i quins articles s\u00f3n m\u00e9s profitosos en cada circumst\u00e0ncia. Les complicacions per orientar-se s\u00f3n tantes que fins i tot en el mateix sector de l\u2019habitatge hi ha discrep\u00e0ncies i dubtes seriosos sobre com incorporar aquest decret i qu\u00e8 passar\u00e0 si finalment decau per falta de suports parlamentaris.<\/p>\n<h4>\u201cCal mirar les circumst\u00e0ncies del contracte per si hi ha pr\u00f2rrogues millors\u201d, avisa el sector<\/h4>\n<p><\/p>\n<p class=\"paragraph\">De moment, al Col\u00b7legi d\u2019Administradors de Finques de Barcelona i Lleida han detectat que una part dels llogaters s\u00f3n perjudicats per aquesta aprovaci\u00f3. Lourdes Ciur\u00f3, directora jur\u00eddica de l\u2019entitat, explica que han trobat casos de llogaters els contractes dels quals vencen d\u2019aqu\u00ed poques setmanes el propietari dels quals no ha avisat de l\u2019extinci\u00f3 en els quatre mesos m\u00ednims preceptius que indica la llei d\u2019 Arrendaments Urbans (LAU). Qu\u00e8 passa llavors? Que en aquestes circumst\u00e0ncies els llogaters tenen dret al que es coneix com a pr\u00f2rroga t\u00e0cita: l\u2019extensi\u00f3 de fins a tres anys del contracte obligat\u00f2riament. Aix\u00f2 passa, com s\u2019ha esmentat abans, quan el propietari del pis no informa de la terminaci\u00f3 del lloguer almenys quatre mesos abans de la data d\u2019expiraci\u00f3.<\/p>\n<p><\/p>\n<p class=\"paragraph\">\u201cEls llogaters que demanen la pr\u00f2rroga del contracte de dos anys en aquestes circumst\u00e0ncies perden un any de lloguer\u201d, afirma Ciur\u00f3.<\/p>\n<div class=\"irr relative z-10\"><\/div>\n<p><\/p>\n<p class=\"paragraph\">En la mateixa direcci\u00f3 apunta Joan Manuel Trayter, catedr\u00e0tic de Dret Administratiu i president de l\u2019 Associaci\u00f3 Espanyola de Dret Urban\u00edstic. Aquest especialista avisa que la vig\u00e8ncia del decret t\u00e9 lloc en 30 dies naturals, \u201ci no h\u00e0bils com s\u2019ha donat a entendre\u201d. Fins i tot va m\u00e9s enll\u00e0: Trayter afirma que la llei impedeix demanar una pr\u00f2rroga quan el contracte encara no s\u2019ha acabat.<\/p>\n<p><\/p>\n<p class=\"paragraph\">Diferents an\u00e0lisis que es duen a terme en aquest moment en l\u2019\u00e0mbit jur\u00eddic indiquen que els contractes realment subjectes a aquest reial decret s\u00f3n molt limitats. La major part correspondria als arrendaments en qu\u00e8 el propietari \u00e9s una persona f\u00edsica i que es van firmar entre el 19 de desembre del 2018 i el 24 de gener del 2019, a m\u00e9s dels que es van firmar en zones tensionades entre el 6 de mar\u00e7 i el 31 de desembre del 2019, sempre que l\u2019arrendador sigui una persona f\u00edsica.<\/p>\n<p><\/p>\n<p class=\"paragraph\">\u201cCada situaci\u00f3 difereix en funci\u00f3 de la personalitat jur\u00eddica de l\u2019arrendador, de la data de la firma i de si hi ha possibilitat d\u2019obtenir una pr\u00f2rroga m\u00e9s gran inclosa en la LAU\u201d, continua Ciur\u00f3. Per aix\u00f2, recomana assessorar-se amb compte abans de demanar la pr\u00f2rroga autom\u00e0tica de dos anys del decret. De fet, en determinades circumst\u00e0ncies hi ha opcions millors per gaudir durant m\u00e9s temps del lloguer.<\/p>\n<p><\/p>\n<p class=\"paragraph\">La base, considera Trayter, \u00e9s la llei d\u2019 Arrendaments Urbans, que va ser reformada pel reial decret llei 7\/2019, que va entrar en vigor el 5 de mar\u00e7 del 2019.
